CASE RESULTS
Federal Victories:
U.S. v. Morton, Case No.: 1:20-cr-9: Mr. Morton was federally indicted for retaliating against a government witness and faced up to 20 years in federal prison. His family hired Attorney Upshaw to fight the case. After a jury trial Mr. Morton was found not guilty on all counts.
U.S. v. Boose, Case No.: 1:20-cr-93: Mr. Boose was federally indicted on federal firearm charges after Mr. Boose’s parole officer discovered firearms in his home. Mr. Boose was on state court parole at the time of his federal indictment and faced up to 15 years in federal prison. After a jury trial Mr. Boose was found not guilty on all federal charges.
U.S. v. Austin, Case No.: 1:23-cr-2: Mr. Austin faced several federal drug distribution and firearm charges. After a hard-fought jury trial he was convicted on most of the charges. However, at Mr. Austin’s sentencing hearing Attorney Upshaw argued for a below guideline- range sentence based on socioeconomic factors (i.e., no income, limited education, no work history nor access to community resources). Attorney Upshaw argued that negative environmental factors significantly influenced Mr. Austin’s life choices. Mr. Austin received a substantial reduction from his original sentencing guideline range of 16 to 20 years. He was ultimately sentenced to 8 years in federal prison.
U.S. v. Henderson, Case No.: 1:22-cr-169: Mr. Henderson was arrested in a home containing multiple drugs and several firearms. After a jury trial in federal court Mr. Henderson was found not guilty of a firearm offense – 18 U.S.C. § 924(c). This statute, section 924(c), requires that a person serve a mandatory consecutive sentence of 5-years in federal prison. However Mr. Henderson, after hiring Attorney Upshaw, was acquitted on this charge. He was unfortunately found guilty on the drug charge.
U.S. v. Covington, 738 F.3d 759 (6th Cir. 2014): Mr. Covington entered a guilty plea in U.S. District Court on federal drug charges. He was sentenced by the court to 18 years in federal prison on the drug charges. Attorney Upshaw appealed Mr. Covington’s sentence to the U.S. Court of Appels arguing that the U.S. District Court improperly classified Mr. Covington’s prior felony convictions as crimes of violence. The appeals court agreed with Attorney Upshaw. Mr. Covington’s case was remanded back to the U.S. District Court for resentencing. Mr. Covington ultimately received a reduced sentence of 4 years.
State Court Victories:
People v. Bowden, Case No. 19-1568 FC: Mr. Bowden was charged in state court with multiple counts of Criminal Sexual Conduct 1 st Degree. His family hired Attorney Upshaw and Mr. Bowden went to trial. Mr. Bowden was acquitted on two of the Criminal Sexual Conduct charges. He was unfortunately found guilty on one of the allegations.
People v. Campbell-Wade, Case No. 16-1409- FH: Mr. Campbell-Wade was charged in state court with possession with the intent to distribute illegal drugs. His family hired Attorney Upshaw and Mr. Campbell-Wade was found not guilty after a jury trial in state court.
People v. Phason, Case No. 16-0168- FH: Mr. Phason was charged in state court with multiple firearm offenses, assault with a dangerous weapon, and possession with the intent to distribute drugs. His family hired Attorney Upshaw and Mr. Phason was found not guilty on all counts after a jury trial in state court.
People v. Braggs, Case No. 14-0180-FC: Mr. Braggs was charged in state court with assault with the intent to commit murder, conspiracy, and armed robbery. His family hired Attorney Upshaw and Mr. Braggs was found not guilty after a jury trial on the conspiracy and assault murder charge. He was unfortunately found guilty on the robbery offense.
People v. Brooks, Case No. 14-0065-FH: Mr. Brooks was charged in state court with resisting and obstructing police officers causing injury to the officers. It was alleged that he fought with multiple officers while they were attempting to detain him for questioning. His family hired Attorney Upshaw and Mr. Brooks was found not guilty after a jury trial.
People v. Robinson, Case No. 12-1576- FC: Mr. Robinson was charged in state court with armed robbery, conspiracy to commit armed robbery, and multiple firearm offenses. His family hired Attorney Upshaw and Mr. Robinson proceeded to trial on all of the charges. He was acquitted on all of his criminal charges and was able to rejoin his family.
People v. Gibson, Case No. 11-0567 FH: Mr. Gibson was charged in state court with distribution of illegal drugs. His family hired Attorney Upshaw and Mr. Gibson went to trial and was acquitted.
